MUNICIPAL LIABILITY

Our firm represents the State of Arizona, Maricopa County, local governments, park districts, and school districts on a regular and ongoing basis. Our attorneys have defended these municipalities against alleged civil rights claims, condemnation actions, eminent domain and inverse eminent domain matters, and claims involving road design.

Some of the accomplishments of the municipal liability group:

  • Our firm was selected to represent the Maricopa County Flood Control District in connection with a claim for $90,000,000.00 for eminent domain, indemnification, and related issues arising out of the failure of a privately owned, historic dam.
  • Two of our attorneys recently prevailed in the trial of several Maricopa County employees involving allegations of civil rights violations. The Plaintiff sought to recover compensatory and punitive damages of approximately $1,000,000.00. Our firm obtained a defense verdict after a lengthy trial in federal court
  • Our firm prevailed in its defense of Maricopa County in a personal injury matter arising out of an automobile accident on a road maintained by the County. The Plaintiff claimed that the road was defectively designed in violation of applicable building codes and industry standards.
  • Our Commercial Litigation Department successfully negotiated the removal of deeds restrictions in a dispute between the State of Arizona, Department of Health Services and Maricopa County Medical Center (Maricopa County Integrated Health Services).
  • Our firm was selected by the City of Tempe, Arizona to represent it's interest in a civil suit against the City of Phoenix, Sky Harbor Airport relating to the Airport's flight path and FAA restrictions.
