LAND USE AND ENTITLEMENT

This practice area falls under the firm's Real Estate Practice Group which is one of the firm's largest and most experienced practice areas. Attorneys in the Land Use and Entitlement Group represent a diverse group of individuals and corporations through all aspects of land use and entitlements. Our clients include Residential Property Owners, Land investors, Master Planned Community Developers, Retail, Office and Commercial Developers, Multi-family and Single Family Residential Developers and National and local retail business. Projects range in size from small single family homes to large master planned communities; from small retail business to large scale commercial or office developments. Our group handles projects throughout the State of Arizona and in every jurisdiction. Because of the depth of the firm's practice, our real estate clients are able to draw upon experience in nearly every area of the law.

The scope of practice in the Land Use and Entitlement area includes the following:

Traditional Entitlement Legal Services: This includes the typical entitlement services including the preparation, filing and work related to any all entitlement applications including general plan amendments, rezoning, conditional and special use permits, plats, lot combinations/splits, variances, site plans, abandonments and signage permits. Work may include: research required to determine necessary entitlements needed and surrounding conditions; preparation of pre-application materials;  attend pre-application meetings with city staff and or elected officials or city departments; preparation of formal applications; coordinate with all development team consultants for application material and all necessary re-submittals; lobby all necessary village, planning commission and city council members prior to hearings; prepare for and attend all public hearing and neighborhood meetings.  Work also includes any necessary coordination or lobbying efforts with outside entities or agencies including adjacent jurisdictions, state departments or utility companies regarding any impacts of development.

·        Support Exhibit Preparation: Preparation of support materials and documents for applications including aerial maps, zoning and general plan maps, neighborhood effort maps, zoning application narratives, utility maps, presentation materials including PowerPoint presentations necessary for lobbying efforts and public hearings.

·        Development Services Support:  This includes all work, meetings and coordination with municipal development services, public works and engineering departments in relation to traditional entitlements, administrative site plan approvals, building permits and financial assurance documents. Work also includes coordination with elected officials and other city departments or outside agencies as needed.

·        Zoning Code Violation Matters:  Includes representing property owners in code violation matters with cities and counties. Work may include negotiating with jurisdictions to remedy violations, appeal violations, draft compliance agreements and appear before administrative hearing officers or municipal courts.

·        Site Selection Support: Services include assisting specific users with local and regional research and due-diligence specific to the needs of a proposed use or user, including comparison of regulatory requirements, process, business and political environment.

·        Neighborhood Effort Support: In certain situations, an entitlement effort may require enhanced work with adjacent neighborhoods, HOAs or community groups. In those situations, work includes direct contact with specific neighbors or groups, hosting meetings, and door-to-door canvassing. Work also includes coordination with an outside neighborhood consultant with all supporting documents including door-to-door marketing materials, letters and petitions.

·        Development Agreements: Drafting, reviewing and negotiating development agreements such as economic agreements, pre-annexation agreements, service agreements, school use /donation agreements and standard entitlement land use agreements.

·        Arizona State Land: Work includes application to the Arizona State Land Department (ASLD) for purchase or commercial lease of property, easements and right-of-ways.  Also includes support in preparing for public auction.
