CONSTRUCTION LITIGATION

The attorneys of the construction litigation group, a subset of the Commercial Litigation Department, represent general contractors, subcontractors, suppliers, owners, insurers, and design professionals in almost every aspect of construction litigation. Our attorneys have represented clients before the Registrar of Contractors, through trial in the Superior Court and appeals before the Arizona Court of Appeals and the Arizona Supreme Court. We have also represented plaintiffs and defendants in a variety of construction defect and personal injury matters arising out of construction site accidents.

We also assist our clients in:

  • Drafting contracts
  • Mechanic's and Materialman's liens
  • Stop notices
  • Bond claims and
  • Other means to insure that our clients are paid for the work they perform.

We work closely with attorneys in other practice groups regarding related legal issues, such as tax and employment matters.

Our attorneys routinely assist clients in perfecting their security interests in real property for which our clients have rendered construction services or supplied construction materials. This includes:

  • Mechanic's and Materialman's liens
  • Claims against payment and performance bonds

  • Contractors license bond claims, and
  • Miller Act and Little Miller Act bond claim
